NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. PARTICIPATION IN THE GIVEAWAY IS OPEN ONLY TO ENTRANTS WHO, AS OF THE DATE OF ENTRY, ARE (A) AT LEAST EIGHTEEN YEARS OLD, (B) RESIDE IN THE UNITED STATES, AND (C) ARE A FANATICS REWARDS MEMBER. This Giveaway is governed exclusively by the laws of the United States.
1. How to Enter. Purchase any Tissot watch during the giveaway period of December 3, 2018 8:00 PM ET – December 31, 2018 8:00 PM ET, (“Giveaway Period”) and be automatically entered to win. To enter without purchase, submit your Fanatics Rewards Member Name and Email during the Giveaway Period on the Giveaway registration page, reachable via the NBA League page on Fanatics.com or via the Fanatics Facebook or Twitter NBA handles. If you do not complete any part of the requirements, you will not be entered in the Giveaway. Non-winning entries will not be carried over to any subsequent giveaway or promotion. Entries received before or after the Giveaway Period will not be eligible. No purchase is necessary to enter or win. A purchase will not increase your chances of winning.
2. Entry Limits. Limit one entry per person. More than one purchase or more than one entry will not increase your chances of winning. Sponsor is not responsible for lost entries or for submission problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. Only legitimate and complete entries are eligible. By entering, entrants agree to abide by these official rules ("Official Rules") and the decisions of Sponsor, and, if specified on the entry form, agree to receive email newsletters and special offers from Sponsor and Sponsor's promotional partners.
3. Eligibility. As indicated above, participation in the Giveaway is open only to entrants who, as of the date of entry, are (a) at least 18 years old, (b) reside in the United States and (c) are a Fanatics Rewards Member. Employees, officers and directors of Fanatics, Inc. (“Sponsor”), as well as its subsidiaries, parents, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of promotion materials and the immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers and directors are not eligible to enter. All federal, state and local laws and regulations apply. Giveaway is void where prohibited, taxed or restricted by law.
4. Selection of Winners. 1 (one) winner will be selected at random on or about January 8, 2019 from all eligible entries received by Sponsor during the Giveaway Period. Winner will be selected based on random selection. Odds of winning will depend on the number of eligible entries received. By entering the Giveaway, entrants fully and unconditionally agree to be bound by these Official Rules and the decisions of the judges and Sponsor, which will be final and binding in all matters relating to the Giveaway.
5. Prize. Upon verification by Sponsor, one (1) winner will receive the following prize (“Prize”): (i) Sponsor-selected prize pack featuring an assortment of apparel and/or accessories based on winner’s team preferences, with an approximate retail value of $500 provided by Fanatics. (“Prize”) , (ii) two (2) Tickets to certain Sponsor-selected events during the NBA All-Star 2019 (“Event”) currently scheduled for February 15 – February 17, 2019 at the Spectrum Center in Charlotte, North Carolina, and (iii) a trip for two (for winner and a guest 18 or older) to Charlotte, North Carolina from February 15 - 18, 2019 (including round-trip domestic airfare between a continental U.S. destination and Charlotte, North Carolina, hotel accommodations selected by Sponsor, and ground transportation between the hotel and the Spectrum Center). Sponsor may require the winner and guest to comply with rules and policies applicable to the Event or Prize and failure to comply may result in forfeiture of all or part of the Prize. The Prize has an approximate retail value of $4,000. Unless required by law, the Prize is not redeemable for cash, and cannot be transferred, sold or distributed to others. In the case of unavailability of the Prize, Sponsor reserves the right to substitute a prize of equal or greater value. Limit of 1 Prize per person. All taxes and unspecified expenses due to the receipt of the Prize(s), as well as all other costs and expenses associated with acceptance of and use of the Prize not specified herein as being awarded (including, without limitation, fees, other transportation, meals and gratuities) are the sole responsibility of the winner(s).
6. Notification. The potential winner will be notified on or about January 8, 2019 via direct email from Sponsor using the information provided in the entry. The potential winner will be required to promptly respond to the message and, in any event, no later than 12:00PM ET on January 10, 2019, and may be required to complete, sign and return, where legal, an Affidavit of Eligibility, Liability/Publicity Release and/or rights transfer document within three (3) days of Prize notification. If any potential winner is considered a minor in his/her jurisdiction of residence, the Affidavit of Eligibility and/or Liability/Publicity Release must be signed by his/her parent or legal guardian. If a potential winner cannot be contacted, or fails to respond to Sponsor's email or call within the required time period (and without any obligation on Sponsor to leave a message), if any Prize or Prize notification is returned as undeliverable, if any potential winner rejects his/her Prize, or in the event of noncompliance with these Official Rules, such Prize will be forfeited and may be awarded to another entrant. Upon Prize forfeiture, no compensation will be given.
7. Conditions. BY PARTICIPATING IN THE GIVEAWAY, ENTRANTS AND WINNERS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS BUSINESS PARTNERS AND PRIZE PROVIDER, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, PARTNERS, REPRESENTATIVES, AGENTS, SUCCESSORS, ASSIGNS, EMPLOYEES, OFFICERS AND DIRECTORS, FROM ANY AND ALL LIABILITY, FOR LOSS, HARM, DAMAGE, INJURY, COST OR EXPENSE WHATSOEVER INCLUDING WITHOUT LIMITATION, PROPERTY DAMAGE, PERSONAL INJURY AND/OR DEATH WHICH MAY OCCUR IN CONNECTION WITH, PREPARATION FOR, TRAVEL TO, OR PARTICIPATION IN THE GIVEAWAY, OR POSSESSION, ACCEPTANCE AND/OR USE OR MISUSE OF PRIZE OR PARTICIPATION IN ANY GIVEAWAY-RELATED ACTIVITY AND FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION. Any and all federal, state and local taxes are the sole responsibility of the winner. Participation in the Giveaway and acceptance of a Prize constitutes the winner’s permission for Sponsor and Prize Provider to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Giveaway, Sponsor or Prize Provider for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. Entrants who do not comply with these Official Rules or attempt to interfere with this Giveaway in any way shall be disqualified. Sponsor is not responsible if the Giveaway cannot take place or if any Prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, fire, natural disasters, weather or acts of terrorism, or any other reason.
8. Additional Terms. Any attempted form of entry other than as set forth above is prohibited. Sponsor, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Giveaway, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Giveaway or downloading any materials in this Giveaway, if any. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Giveaway should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Sponsor may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Giveaway or web site, if applicable. Sponsor may prohibit an entrant from participating in the Giveaway or winning a Prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Use of Data. Sponsor may collect personal data about entrants. By participating in the Giveaway, entrants hereby agree to Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy, if applicable as well as consent to sharing personal data with Prize Provider (Tissot) for purposes of fulfilling the Prize and marketing.
10. List of Winners. To obtain a list of winners, send a self-addressed, stamped envelope within two months after the end of the Giveaway Period to: Fanatics, c/o Loyalty Marketing Group, Attn: 2019Tissot Giveaway, 1 Franklin Parkway, Building 910, 2nd Floor, San Mateo, CA 94403.
11. Sponsor. Fanatics, Inc., 8100 Nations Way, Jacksonville, FL 32256.
NBA Required Terms
(i) Definition of “NBA Entities”: NBA Properties, Inc., the National Basketball Association (the “NBA”), and the NBA member teams (collectively, the “NBA Entities”). If the promotion is conducted online, include “NBA Media Ventures, LLC” in this definition. If the promotion is conducted in China, include “NBA China” in this definition.
(ii) Exclusion of Employees of the NBA Entities from Eligibility: Employees of the NBA Entities, including affiliates, agents and immediate family members and/or those living in the same household of such employees, are not eligible to enter or win the promotion.
(iii) Indemnification of the NBA Entities: The NBA Entities and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by any reason, including the acceptance, possession, use or misuse of the prize and/or participation in this promotion.
(iv) Right of Publicity Release: Participants in this promotion (if minor, his/her parent or legal guardian) agree to be bound by these Official Rules and agree that the NBA Entities and their designees and assigns may use the participant’s name, voice, city/state of residence, photos, video or film clips, and/or other visual likeness for advertising and/or trade purposes and/or for any other purpose in any media or format now or hereafter known without further compensation (financial or otherwise), permission or notification.
Winner release
With respect to any contest, sweepstakes or promotion which has prizing that (i) exceeds Five Hundred Dollars ($500) in value, (ii) offers autographed merchandise, or (iii) offers travel of any value, NBAP requires the Partner to submit to NBAP for review and approval an Affidavit of Eligibility and Receipt in which the winner (a) verifies his or her identity and allows for the use of his/her name and likeness (Right of Publicity) by NBAP and the Partner with no further compensation; and (b) agrees to release NBAP and the Partner from any claims or damages that might arise in connection with the contest, sweepstakes, or promotion.
