SMS Marketing Terms of Use

By opting in to receive informational and marketing text messages from Fanatics, LLC, including communications from its subsidiaries, affiliates, and partners (collectively referred to as “Fanatics,” “we,” “us,” or “our”), you agree to these SMS Terms of Use (“Messaging Terms”). Your participation in the Fanatics mobile messaging program (the “Program”) is also governed by our Privacy Policy, Terms of Use, and any other applicable terms related to our services. These Messaging Terms supplement, and do not replace, those agreements.
Our Terms of Use contain an arbitration provision and a class action waiver, which are incorporated into these Messaging Terms and apply to your participation in the Program. By using the Program, YOU AGREE TO ARBITRATE ANY DISPUTES YOU HAVE WITH US, AND YOU WAIVE THE ABILITY TO BRING CLAIMS AGAINST US IN A CLASS ACTION FORMAT.
Consent to Receive Automated Communications
By voluntarily providing your mobile number, you expressly consent to receive recurring automated text messages from or on behalf of Fanatics. This may include promotional offers, product updates, order notifications, account-related alerts, and shopping cart reminders. Messages may be sent using an automatic telephone dialing system, artificial intelligence (AI)-powered communication tools, or other automated technologies.

- You may withdraw your consent at any time by replying “STOP” to any message or following the opt-out instructions provided in our communications or outlined in the “Your Choices” section of this Privacy Policy.
Cart Reminder Messages
Our SMS program may include shopping cart reminders. These messages are triggered when you add items to your cart but do not complete your purchase. To identify cart abandonment, we use automated tracking technologies such as cookies, pixels, and session replay tools. These technologies help us detect when a cart has been left behind and enable us to send timely reminders to assist you in completing your transaction.
Eligibility and Program Scope
The Program is intended for U.S. residents with mobile numbers registered in the 50 United States or the District of Columbia. By enrolling, you confirm that:
- You are at least 18 years old (or the age of majority in your jurisdiction)
- You are the current authorized user of the mobile number provided
- You have the authority to incur any messaging or data charges
Message frequency may vary. We reserve the right to change the short code or phone number used to send messages at any time.
Message Delivery and Limitations
Not all mobile devices or carriers support our messaging services. Fanatics, its service providers, and participating carriers are not liable for delayed, undelivered, or misdirected messages. You are solely responsible for any charges imposed by your wireless provider.
Opt-In Disclosures
By opting in, you acknowledge and agree that:
- You will receive recurring marketing and/or informational messages
- Message frequency may vary
- Message and data rates may apply
- You can reply STOP to cancel or HELP for assistance
- You confirm that you have read, understood, and agree to all relevant terms, conditions, and policies governing participation
- You may receive promotional and personalized marketing text messages (e.g., cart reminders) based on your interactions with our website
Opt-Out and Help Instructions
- You may opt out of the Program at any time by texting STOP to the short code used to contact you. You will receive a final confirmation message. Only recognized keywords (STOP) will be processed.
- For help, text HELP.
Opting out of one Fanatics text messaging Program does not automatically unsubscribe you from other messaging programs we offer, such as email campaigns or text communications operated by affiliated Fanatics entities. Each messaging Program, whether operated by Fanatics or one of its subsidiaries or affiliates, requires a separate opt-out to fully discontinue communications. If you participate in multiple Programs, you must follow the designated opt-out instructions for each to ensure complete removal from those communications.
Duty to Notify and Accurate Information
You agree to provide accurate contact information and promptly notify us of any changes to your mobile number. Failure to do so may result in unauthorized messages being sent to others, for which you may be held liable.
Indemnification to Fanatics
In addition to any other indemnification, you agree to indemnify, defend, and hold us harmless from and against any and all privacy, tort, or other claims, losses, liability, costs, and expenses (including reasonable attorneys’ fees), including claims under the Federal Telephone Consumer Protection Act or any state law equivalents, including claims relating to your voluntary provision of a telephone number that is not owned by you and/or your failure to notify us of any changes in your mobile telephone number.
Release of Claims
By participating in the Program, you release Fanatics from any claims or liabilities under federal or state laws related to telemarketing, including the TCPA, Truth in Caller ID Act, Telemarketing Sales Rule, and/or any state and local acts or statutes that may apply to the Program.
Termination and Modification
We may suspend or terminate your participation in the Program at any time, with or without notice. We also reserve the right to modify, suspend, or permanently discontinue the Program itself at any time, for any reason, without prior notice. These Messaging Terms may also be updated at our discretion. Continued participation after any changes constitutes your acceptance of the updated terms.
Changes to These Messaging Terms
These Messaging Terms may change at any time. The revised Messaging Terms will apply to you for any text messages you receive after the revision date, so please check back from time to time.
