THIS SWEEPSTAKES IS OPEN TO LEGAL U.S. RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA AND ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE RULES BELOW). VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
Name: Fanatics ‘Chance to Win a Trip to the NBA Finals with OBJ’ Sweepstakes (the “Sweepstakes”).
Timing:The Sweepstakes begins at 12:00 a.m. Eastern Time (ET) on May 15, 2023 and ends at 11:59:59 PM Eastern Time (ET) on June 1, 2023 (the “Sweepstakes Period”). Administrator’s computer/internet is the official time-keeping device for this Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
Who May Enter: Sweepstakes is open to legal U.S. residents of the fifty (50) United States and the District of Columbia who are age 18 or older as of date of entry and who have a valid U.S. driver’s license or government-issued photo ID, excluding the following classes of persons who are not eligible to enter:
- Employees, officers, and directors of Fanatics Holdings, Inc. (“Sponsor”), Million Dollar Media (“Administrator”), Odell Beckham Jr., the NBA, and each of their respective franchisees, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this Sweepstakes (collectively “Related Parties), and the members of the immediate families or households of any of the above, whether or not related. For the purpose of these Official Rules, “household members” means those people who share the same residence and/or mailing address at least three months per year with one or more Related Party. “Immediate family members” includes, for purposes of this Sweepstakes, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grand children (including step grandchildren) and each of their respective spouses.
How to Enter – Two Methods:
- Online Transaction: During the Sweepstakes Period, visit www.fanatics.com or www.fansedge.com and spend $25.00 or more (including sales tax, shipping fees or any other transaction fees) during any single transaction (“Qualifying Purchase”). Qualifying Purchase may include one or more merchandise items. Multiple transactions may not be combined for the purpose of achieving a Qualifying Purchase. All Qualifying Purchases must be completed by no later than 11:59:59 PM ET on 6/1/2023 in order to be valid for this Sweepstakes (each a “Transaction Entry”).
Mail-in Entry (No Purchase Necessary): Hand print your complete name, address (including city, state and zip code), email address, birth date, and daytime and evening phone numbers (including area codes), on a 3x5 card or piece of paper, and mail your entry in a #10, business-size envelope with first-class postage affixed to: Chance to Win a Trip to the NBA Finals with OBJ’, P.O. Box 278, Woodbridge, NJ 07095. Information on all entries must be hand-printed. No mechanically reproduced or photocopied entries allowed. Limit one (1) mail-in entry per outer mailing envelope. All mail-in entries must be postmarked by no later than 6/1/2023, and received by no later than 6/4/2023 (each a “Mail-in Entry”).
Transaction Entries and Mail-in Entries are collectively, “Sweepstakes Entries” and individually, a “Sweepstakes Entry.” Eligible participants having submitted a Sweepstakes Entry are each individually referred to as an “Entrant” and collectively, as “Entrants.”
Entrant agrees to these Official Rules and that Sponsor and Related Parties are authorized to contact Entrant via email, mail, phone or any other form of media to make Entrant aware of information pertinent to the Sweepstakes, and to distribute information regarding Sponsor’s featured products, discounts, special events or promotional offers (“Marketing Communications”).
Employees, officers, and directors of Sponsor, Administrator, Odell Beckham Jr., the NBA, and each of their respective franchisees, affiliated companies, subsidiaries, partners, representatives, agents, successors, assigns, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this Sweepstakes (collectively, the “Released Parties”) are not responsible for lost, late, misdirected, illegible, incomplete, invalid, unintelligible, damaged, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received or lost due to any technical error or failure, human or programming error, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information or effects of hackers or failure of any electronic equipment, computer transmissions and/or network connections; all of which will be disqualified.
Each Entrant must submit an entry on his/her own behalf. Any entry submitted on behalf of another individual or using another person’s email address or name will be disqualified and therefore ineligible to claim any prize. No mechanically reproduced or automated entries permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void. In the event of a dispute as to any on-line registration, the authorized account holder of the e-mail address used to register will be deemed to be the registrant and he/she must be eligible according to these Official Rules. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. All entries received become the property of the Sponsor and will not be returned.
Winner Selection, Notification and Verification (maximum of 1 prize winner): At the conclusion of the Sweepstakes Period, the Administrator shall conduct one random prize drawing and select from among all Sweepstakes Entries received to determine one (1) potential winner (the ‘Potential Winner’).
If the Administrator is unsuccessful in its attempt to reach and speak directly with a Potential Winner by phone after the the initial notification attempt to the phone number , then that Entrant may be disqualified (as solely determined by the Administrator) and an alternate Potential Winner may be randomly selected from among the remaining eligible entries and notified as per the procedures outlined above (time permitting). Note: phone messages will not be left during the winner notification process. If less than the required number of entries are received in the Sweepstakes, or Administrator is unable to confirm one (1) Potential Winner due to time constraints, less than the promoted number of prizes in the Sweepstakes will be awarded.
During winner notification, Potential Winner must verify eligibility, and indicate ability and willingness to accept the prize. The Potential Winner will then receive an official prize notification packet via email, which must be completed and returned to Administrator within one (1) day of receipt, time permitting. If a Potential Winner does not meet the eligibility requirements, or is unable or unwilling to accept the prize or elects to decline the prize, that entry shall be disqualified and, at Sponsor’s discretion and time permitting, an alternate entry will be selected at random from among all remaining eligible entries and a new Potential Winner for the prize will be notified per the procedures outlined above. Any disqualified Entrant will not receive an alternate prize substitution or compensation. Decisions of the Administrator in the selection and determination of Grand Prize winners and all matters relating to this Sweepstakes are final and binding.
Sponsor reserves the right to conduct a background check on the Potential Winner and Potential Winner's guest (“Potential Winner’s Guest”), and reserves the right in its sole discretion to disqualify any Potential Winner or Potential Winner's Guest based on the results of such background check, if the Sponsor determines in its sole discretion that awarding the prize to such Potential Winner or Potential Winner's Guest might reflect negatively on Sponsor, or put Sponsor or any Released Party in danger. Sponsor is not obligated to share any specific results of background check with any Potential Winner or Potential Winner Guests, whether the background check resulted in a disqualification or not. Factors that could result in disqualification as a Winner or Winner's Guest include, without limitation, having been convicted of a felony or misdemeanor, being delinquent on a government-ordered payment, such as child support, spousal support, alimony, tax payments, etc., or any other criminal or civil offense determined at the sole discretion of Sponsor. Where necessary to fulfill this requirement in any jurisdiction, Potential Winner and/or Potential Winner’s Guest must provide authorization and/or complete any forms reasonably required to facilitate such background check.
All of the following will apply to verify a Potential Winner: 1) Potential Winner must complete and return, within 1-day of date of receipt, a prize acceptance form, a W-9 form, an affidavit of eligibility, a liability/publicity release (where permitted), and a travel release form required for Winner and any Potential Winner Guest (“Paperwork”); 2) Winner may be required to present a copy of a valid social security card and a valid driver’s license as a condition of receiving the Grand Prize; 3) Winner will be issued an IRS Form 1099 reflecting the actual value of the prize won; and 4) Winner will be responsible for paying all applicable taxes (including, but not limited to all local, state and federal taxes) on the prize received. Failure to collect or properly claim the prize in accordance with these Official Rules will result in forfeiture of the prize. If forfeited for any reason, Winner will not receive any other prize substitution or compensation, and the prize will remain the property of Sponsor and will not be awarded, except as provided herein. Upon receipt of completed Paperwork within Administrtator provided deadline and fulfilling all other requirements per these Official Rules, Potential Winner will be designated as the winner (“Winner”).
Grand Prize Award – Maximum of one (1) Grand Prize Award available: The Entrant who is confirmed as the Winner will be eligible to receive one (1) Grand Prize. The Grand Prize is:
- Two (2) roundtrip domestic coach-class airline tickets from major airport nearest Winner’s residence (as determined solely by Administrator) to the major airport in the city which is hosting a 2023 NBA Finals game that has been designated by Sponsor to be the selected game for Winner to attend (“NBA Finals Game”)
- 2-night hotel accommodation for one (1) standard hotel room, double occupancy in the metropolitan area of the city which is hosting the NBA Finals Game.
- Roudtrip ground transportation from hotel to the NBA Finals Game, paid in the form of a $300.00 ride service gift card
- Two (2) tickets valid for admission to the NBA Finals Game (selected game date to be determined by Sponsor)
- Meet and greet with Odell Beckham Jr. during the NBA Finals Game
The maximum retail value the Grand Prize is $4,950.00
The following will apply to the Grand Prize: Travel arrangements must be booked through Administrator. Departure date, accommodations and airline class of service are subject to availability. Selection of airline and hotel are solely within Sponsor's discretion. Grand Prize Winner and guest must travel together on the same itinerary. If the travel companion (i.e. guest of Grand Prize Winner) is a minor under the age of eighteen (18) as of 6/1/2023, the Grand Prize winner must be the parent or legal guardian of such travel companion. All ground transportation including airport and hotel transfers, parking, meals, gratuities, checked baggage fees, airline seat assignment fees, hotel resort fees, incidental expenses, applicable taxes (including, but not limited to all local, state and federal taxes) and any other expenses not specified herein as being included in the prize award are the sole responsibility of winner. Sponsor is not responsible for late, lost, damaged or stolen luggage. Winner will be required to provide a credit card at the time of hotel check-in, and hotel will place a temporary ‘hold’ on credit card to cover any incidental charges by winner and/or winner’s guest. Temporary hold dollar amount on credit card is subject to hotel policy. It is recommended that each Winner and travel companion obtain sufficient personal insurance (at their own expense) prior to departure. Any Winner requested changes to completed travel arrangements, once booked, are the sole responsibility of the Winner, and are solely at the Winner’s expense. Winner and travel companion hereby release Sponsor from any duty to provide, check, or verify any and all necessary ID’s, passports, visas and tourist cards, birth certificates, vaccination certificates, and any other travel requirements (“Personal Documents”). Sponsor shall not have any responsibility for the replacement of lost or stolen Personal Documents or tickets, coupons, vouchers, receipts or other documents pertaining to the prize (“Travel Documents”) once the Travel Documents have been provided to winner and travel companion. If air travel is not required due to Grand Prize Winner’s proximity to prize location as determined by Administrator, ground transportation may be substituted for round trip air travel at Administrator’s sole discretion. If Winner elects to take prize trip without one or more guests, components of the grand prize trip will be awarded in increments/quantities suitable for one traveler and winner will not receive any compensation or substitute/alternate prize for same. Winner agrees to maintain his or her behavior and the behavior of its guest in accordance with all applicable laws, generally accepted social practices, and adhere to all rules and regulations applicable to any airline, hotel, venue or other entity connected to participation in any prize activity, including, without limitation, use of a prize component. Winner understands and agrees that if Winner or Winner’s guest is removed from any activity at any time, or if the Winner’s or Winner’s guest’s behavior at any point is disruptive, causes damage or could cause damage to person, property or otherwise violates the policies of an entity associated with the prize, then Winner may be required to forfeit the remainder of the prize without substitution or compensation.
Game date and seat location shall be as solely determined and designated by Sponsor. Meet and greet experience portion of prize will be determined by Sponsor and is subject to availability. In the case of unavailability, the remainder of the prize will be awarded without the meet and greet experience. Tickets are subject to availability, and any applicable Arena capacity restrictions and regulations, including COVID-19 vaccination or testing policy or mask-wearing policies. Winner and guest must abide by all league/team/arena policies. No refund or compensation will be made in the event of the cancellation or delay of any game.
Actual game date and time are determined in the sole discretion of the league/team/arena, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event any game date is not played or attendance is restricted or prohibited due to weather, pandemic, an Act of God, an act of terrorism, civil disturbance, work stoppage or any other reason. Released Parties will not be responsible for any game date delay, rescheduling, postponement or cancellation due to weather, pandemic, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other event that may cause the cancellation or postponement of the game. Prize award may be delivered to winner only to the registered email address or mobile phone number (for mobile/digital tickets) as provided at the time of entry and Winner notification. Winner is solely responsible for any required software application for access to mobile or digital ticket delivery. Once delivered, prize shall be considered delivered to Winner and Released Parties shall have no responsibility for any delivery that is delayed, damaged, lost, misdelivered, not received or stolen. If, for whatever reason, the game is cancelled, tickets will not be awarded, and Released Parties will have no further obligation to Winner. If game is postponed or rescheduled, the ticket terms will govern, and Released Parties will have no further obligation to Winner.
Winner and guest fully understand that (a) the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19”) is extremely contagious and there is an inherent risk of exposure to COVID-19 in any place where people are or have been present; (b) no precautions, including the protocols that may be implemented from time to time based upon public health and government-sponsored guidelines (collectively, the “Protocols”), can eliminate the risk of exposure to COVID-19; (c) while people of all ages and health conditions have been adversely affected by COVID-19, certain people have been identified by public health authorities as having greater risk based on age and/or underlying medical conditions; and (d) exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, other short-term and long-term health effects, and/or death, regardless of age or health condition.
Additional Rules & Restrictions: By participating, Entrants agree to (1) abide by and be bound by these Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Sweepstakes, and (2) receive email newsletters, special offers or other communications from Sponsor and Sponsor's promotional partners. Sponsor reserves the right to substitute a prize with another prize of equal or great value if the prize is not available for any reason, as determined by Sponsor in its sole discretion. In the event an Entrant wins a prize, and is later found to be in violation of these Official Rules he/she will be required to forfeit the prize or to reimburse Sponsor for the stated value of the prize if such violation is discovered after Winner has used the prize. Participation in Sweepstakes constitutes permission for the Sponsor and its designees to use Entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render Entrants ineligible for any prize.
BY PARTICIPATING, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW ENTRANTS AGREE TO HOLD ALL RELEASED PARTIES HARMLESS FROM ANY CLAIMS, LOSSES, ACTIONS, OR DAMAGES OF ANY KIND, WHETHER ACTUAL, INCIDENTAL OR CONSEQUENTIAL, FOR INJURY (INCLUDING BUT NOT LIMITED TO DEATH), DAMAGES, LOSSES OR EXPENSES ARISING OUT OF OR RELATING TO ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES, OR THE ACCEPTANCE, POSSESSION OR USE/MISUSE OF A PRIZE, OR PARTICIPATION IN PRIZE-RELATED ACTIVITIES (INCLUDING BUT NOT LIMITED TO TRAVEL OR ACTIVITY RELATED THERETO), AND, INCLUDING, WITHOUT LIMITATION, FOR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, INVASION OF PRIVACY, COPYRIGHT INFRINGEMENT, TRADEMARK INFRINGEMENT, OR ANY OTHER INTELLECTUAL PROPERTY-RELATED CAUSE OF ACTION, AND TO ASSUME ALL LIABILITY THEREOF. Released Parties shall not be liable to Winner or any other person for failure to supply a prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control. Participation in the Sweepstakes and acceptance of the Grand Prize constitutes each Winner’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information, and/or any statements made by each winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.
Entrants are restricted to use of ordinary and typical computer equipment, mobile phone equipment, Internet access and cellular networks. Sponsor disclaims all liability for the inability of an Entrant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor’s control, or otherwise. Released Parties disclaim any liability for entries not received due to technical difficulties or transmission errors. Released Parties disclaim all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online Entrant's ability to participate in the Sweepstakes, and any injury or damage to Entrant’s or any other person’s computer or mobile phone related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitations, errors which may occur in connection with the printing or advertising of this Sweepstakes, administration or execution of the Sweepstakes, the cancellation of the game, the processing of entries or in the announcement of the prizes or prize winners. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Sweepstakes website.
Sponsor reserves the right to cancel, modify or terminate the Sweepstakes if fraud, misconduct or technical failures destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor/Administrator, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor/Administrator, in their sole discretion. In the event of early termination of the Sweepstakes, Sponsor reserves the right to determine prize winner in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination.
Odds: The odds of being selected as a Winner are dependent upon the total number of eligible entries received at the time of the drawing.
In Case of Disputes: By participating, each Entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of New Jersey; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Jersey or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of New Jersey
Use of Data. Sponsor may collect personal data about entrants. By participating in the and, entrants agree to Sponsor's collection and usage of their personal information as well as consent to sharing personal data with others for purposes of fulfilling the Grand Prize and marketing.
